Definition of Terms
- “Macroption” is a trading name of Petr Houstecky, registered in the Czech Republic with business ID (IC) 76488462 and registered office at Manesova 345/13, Ceske Budejovice, 37001, Czech Republic.
- “Macroption Website” is the website at the macroption.com domain, including all pages at www.macroption.com and all pages at all other subdomains.
- “Macroption Software” is any software published by Macroption, provided either free or for a charge, including but not limited to Excel calculators and spreadsheets.
- “Macroption Products” are products published by Macroption, provided either free or for a charge, including but not limited to Macroption Software, reports, guides, ebooks and collections of resources.
- “Macroption Content” is any content published by Macroption, including but not limited to Macroption Website, Macroption Products, emails and other content.
- “User” is any person visiting and remaining on Macroption Website and/or using Macroption Content. Users include Registered Users and Unregistered Users.
- “Registered User” is any person who has filled out a registration form and created an account on Macroption Website.
- “Unregistered User” is any person who is a User, but not a Registered User.
- “Other Party Content” is any content not published by Macroption, including but not limited to online content, offline content, products, services, data, books and other media.
All Macroption Content is protected by copyright. No part of Macroption Content, including but not limited to text, charts, graphics, design, spreadsheets, formulas and code, must not be reproduced in any way without prior written permission from Macroption.
Macroption Products, Account and Downloads
Buying a Macroption Product grants User the right to download the particular files on his or her computer for personal, non-commercial use only, unless an explicit written permission for other use has been given by Macroption. Uploading the files on the Internet or another network, sending them by email, or otherwise redistributing them is strictly prohibited.
Access to downloads is guaranteed only within the first 30 days after purchase. After this period Macroption reserves the right to deactivate the User’s account and/or remove download links without warning.
Every Registered User must protect his/her Macroption account from unauthorized access and abuse and must not share Macroption login information (username and password) with anyone.
Macroption reserves the right to cancel a User’s account at any time in case of breach of this Agreement, without refunds or compensation for lost access to Macroption Content, free or paid.
When buying a Macroption Product, User has the right to change his/her mind for any reason within the first 30 days after purchase and receive full refund.
No refunds are given for any reason if more than 30 days have passed since the purchase.
No refunds are given for any reason if the User’s account has been terminated due to a breach of this Agreement.
Macroption Software is always provided “as is”, in the condition available at the moment of purchase, without any rights for future updates or customizations and without warranty of any kind.
Macroption does not assume responsibility for the continued operation, availability and compatibility of Macroption Software after 30 days have passed from the moment of purchase.
Basic technical support is provided within the first 30 days after purchase. This support only covers basic functionality of the Macroption Software itself and does not include support for any other related software, even when such software is required for the use of the Macroption Software. For instance, among other things the technical support does not include queries regarding the User’s spreadsheet software, such as Microsoft Excel, the User’s operating system and its settings, or external data sources, such as the Yahoo Finance website.
Macroption does not assume responsibility for the continued operation, availability and compatibility of any external software, such as Microsoft Excel, or external data sources, such as Yahoo Finance, even when such software or data source is required for the use of the Macroption Software.
Limitation of Liability
All Macroption Content, including but not limited to Macroption Website and Macroption Products, is provided for educational purposes only. It must not be treated as financial, investment or trading advice under any circumstances. Prices, returns and other figures calculated using theoretical models may significantly deviate from reality. Macroption does not provide any financial services. There is a risk of loss in trading or investing; sometimes the loss may exceed the capital invested. Users must not make any investment or trading decisions without first consulting a broker or regulated adviser.
Macroption is not liable for any damages resulting from using Macroption Content, including but not limited to Macroption Website and Macroption Products, or acting upon any information or calculations it provides, even when such information or calculations are inaccurate, incomplete, outdated or plain wrong, and even when the particular Macroption Software works differently than advertised or expected. These damages include, but are not limited to, damages to life, health, property, equipment, loss of data, infection by malware, viruses and other harmful software, financial or business losses, also including lost revenue or opportunities, non-financial and non-material damages, and damages to Users and other entities.
Macroption Content may mention or refer to Other Party Content. This must not be treated as a recommendation or endorsement under any circumstances, even when the wording might seem so. Macroption does not own or control and therefore can not influence Other Party Content, its accurateness, timeliness and compliance with the law. Macroption is not liable for any damages resulting from using Other Party Content.
Affiliate and Referral Relationships
Macroption may have affiliate or referral relationships with owners, authors, and providers of Other Party Content and may receive a commission or referral fee when User is referred to Other Party Content by Macroption. User is aware of the potential conflict of interest these relationships may cause.
Other Party Trademarks
Some names, labels, abbreviations, and tickers discussed in Macroption Content, including but not limited to “S&P”, “VIX”, or “CBOE”, are trademarks of other parties. These other parties have no responsibility for the quality, accuracy, timeliness, and completeness of Macroption Content.
Position Disclosure Policy
Macroption, its owners and/or the authors of Macroption Content may have positions in markets or securities mentioned in Macroption Content. Such positions are disclosed, in an appropriate form, only if held at the time of publishing the particular piece of Macroption Content and only if the market value of the particular position exceeds USD 1,000,000 or equivalent. User is aware of the potential conflict of interest this may cause.
When creating an account on Macroption and/or buying Macroption Products, User may be asked to provide personal information including but not limited to name and email address. This personal information is stored in databases owned and maintained by Macroption or other entities providing these services to Macroption. Macroption does not share or sell personal information of Registered Users to other parties. While effort is being made to keep it secure, Macroption does not assume responsibility for a possible loss or inadvertent release of personal information of Users for reasons beyond Macroption’s control, such as in case of theft, disaster or technical failure.
Additional personal information may be required by external payment processing providers when a Registered User is using their online payment interface for making payments to Macroption.
Changes to This Agreement
Macroption reserves the right to add, remove, or amend parts of this Agreement at any time. Such modifications will be effective immediately. It is a responsibility of User to review the Agreement whenever using Macroption Content.
Any changes to this Agreement proposed by User will be immediately rejected by Macroption and will be of no effect.
Applicable Law and Jurisdiction
This Agreement is to be governed by and interpreted in accordance with the law of the Czech Republic. Disputes between Macroption and Users that arise under this agreement and from a User using Macroption Content in general are to be resolved by the courts of the Czech Republic.
If any clause of this Agreement is determined by any court or other competent authority to be unlawful or otherwise unenforceable, the other clauses of this Agreement still apply and continue in effect. If any unlawful and/or unenforceable clause would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the clause will continue in effect.
